Defamation Case - law34-cases

1. a 1985 case - Kansas Appellate courts

2. Facts of the case - The employee alleged that several managers of the employer maliciously communicated defamatory remarks about him between themselves while acting within the scope of their employment. The employer filed a motion to dismiss on the grounds that intracorporate communications did not constitute publication. The trial court sustained the motion to dismiss for failure to state a claim upon which relief might be granted. On appeal, the court held that interoffice communications between supervisory employees of a corporation, acting within the scope and course of their employment, regarding the work of another employee of the corporation, constituted publication to a third person sufficient for a defamation action.

3. Give the complete case citation - i.e. Name of parties, volume number, name of case reporter, page number (date case decided)

4. State the name of the party who won the case - i.e. the actual name - not "plaintiff"

5. Give the Court rule (in your own words) - use the "key legal words" used by the court in deciding the case - or the key "case precedent" - if it used an earlier case in deciding this case

6. Give the reasoning or rationale of the court used in resolving the case (in your own words)

now post your work under "assignments"

Good luck. Prof J.
