Our client is Dra. Frey Contreras-Jimenez who has been charged with a violation of PC 274 - which reads in part:
'Every person who provides, supplies, or administers to any woman, or procures any woman to take any medicine, drug, or substance, or uses or employs any instrument or other means whatever, with intent thereby to procure the miscarriage of such woman, unless the same is necessary to preserve her life, is punishable by imprisonment in the State prison not less than two nor more than five years.'
Dra. Frey Contreras-Jimenez, a licensed doctor of obstetrics, gave a piece of paper to one of her patients, referring her to an abortionist in Tijuana. The Doctor was charged with a violation of PC 274, and now comes into our law firm, and requests to be represented.
As a paralegal in our law office please review the case of People v. Belous - a 1969 California Appellate court case and prepare a legal memorandum on whether our law firm should prepare a motion to contest the constitutionality of the statute.
